1. Acceptance of Terms
By accessing or using HookOS (the “Protocol”), including the website at hookos.fun, smart contracts deployed on Base and other EVM chains, the HookOS SDK, APIs, bots, and all related services (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.
2. Description of Services
HookOS is a decentralized protocol for launching tokens with programmable AMM hooks on EVM-compatible blockchains. The Services include token deployment, hook registration, PvP arena wagering, staking, governance, and related marketplace and social features. HookOS provides the user interface and smart contracts; all on-chain activity is executed by users directly on public blockchains.
3. Eligibility
You must be at least 18 years old and legally able to enter into contracts in your jurisdiction. You must not be a resident of, or located in, any jurisdiction where use of DeFi protocols is prohibited. You are solely responsible for ensuring compliance with your local laws.
4. Wallet & Account Responsibility
You are solely responsible for the security of your wallet, private keys, and seed phrases. HookOS does not custody any funds or have access to your wallet. Lost keys cannot be recovered by HookOS. You are responsible for all activity conducted through your wallet address.
5. Risks
- Smart contract risk: While contracts are audited and tested, no smart contract is guaranteed to be free of vulnerabilities.
- Financial risk: Tokens launched on HookOS may lose all value. Trading, wagering, and providing liquidity involve risk of total loss.
- Regulatory risk: The regulatory environment for DeFi is evolving. Changes in law may affect availability of Services.
- Hook risk: Custom hooks modify market behavior. Hooks may cause unexpected price impact, fees, or restrictions.
- MEV risk: Transactions on public blockchains are subject to miner/validator extractable value.
6. Prohibited Uses
You agree not to: use the Services for money laundering, terrorism financing, or sanctions evasion; deploy tokens that infringe intellectual property; manipulate markets through wash trading, sybil attacks, or artificial volume; exploit bugs or vulnerabilities (report them instead); use automated tools to abuse rate limits, quest systems, or referral programs; impersonate HookOS team members or official accounts.
7. Fees
The Protocol charges fees on token launches, hook registrations, swaps, arena wagers, and marketplace transactions. Fee amounts are set by smart contracts and may be adjusted via governance. Revenue splits are enforced on-chain via the RevenueSplitRegistry contract. Current default splits: 40% FORGE Stakers, 20% Liquidity Incentives, 15% Hook Creators, 15% Treasury, 10% Platform Ops.
8. Intellectual Property
The HookOS brand, logo, website design, and documentation are owned by HookOS Labs. Smart contracts deployed on public blockchains are open source. Hooks created by users remain the intellectual property of their creators, subject to any license terms set by the creator.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. HOOKOS DOES NOT GUARANTEE UPTIME, ACCURACY OF DATA, OR PROFITABILITY. HOOKOS IS NOT A FINANCIAL ADVISOR AND DOES NOT PROVIDE INVESTMENT ADVICE. USE AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKOS AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF FUNDS, DATA, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICES.
11. Indemnification
You agree to indemnify and hold harmless HookOS, its contributors, and affiliates from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
12. Governance
Certain parameters of the Protocol may be modified through on-chain governance by holders of the governance token. Governance decisions are binding on all users of the Protocol.
13. Modifications
We may update these Terms at any time. Material changes will be posted on the website. Continued use of the Services after changes constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
